Updated 2025-09-01California requirements for communicating with EL families in their primary language, parent rights notifications, and ELAC/DELAC advisory committees.
Language Access Requirements
Translation of Notices (EC §48985)
When 15% or more of students at a school speak a single primary language other than English, the school must:
- Translate all notices, reports, statements, and records sent to parents into that language
- This includes disciplinary notices, progress reports, IEP documents, and school communications
Interpretation Services
Schools must provide oral interpretation at:
- Parent-teacher conferences
- IEP meetings
- Disciplinary hearings
- School events and meetings
- Enrollment and registration
Parent Rights
Parents of English Learners have the right to:
- Be informed of their child's EL status within 30 days of enrollment
- Receive information about their child's English proficiency level and program placement
- Choose among available language programs (per Proposition 58)
- Participate in their child's education, including reclassification decisions
- Receive communications in their primary language (when required by EC §48985)
- Participate in the ELAC and DELAC advisory committees
Advisory Committees
English Learner Advisory Committee (ELAC)
- Required at every school with 21 or more EL students
- Must have EL parent representation proportional to EL enrollment
- Advises the principal and staff on programs for ELs
- Assists in developing the school's needs assessment and language census
District English Learner Advisory Committee (DELAC)
- Required in districts with 51 or more EL students
- Advises the school board on district-wide EL programs and services
- Reviews and provides input on the LCAP regarding EL programs
Dean/Counselor Best Practices
- Use interpreters — Never use students as interpreters for their parents
- Provide translated documents — Ensure disciplinary notices are translated as required
- Welcome families — Create a culturally responsive school environment
- Know your ELAC — Attend meetings and connect families with the committee
- Understand implicit bias — Be aware of how language barriers may affect perceptions of student behavior
