Teacher Classroom Removal (EC §48910)

Understanding a teacher's authority to remove students from class and the dean's/counselor's responsibilities upon referral.

Teacher Authority Under EC §48910

A teacher may suspend a student from class for the day of the removal and the following day for any act listed in EC §48900. This is separate from an administrative suspension.

Key Requirements

  1. Teacher must report — The teacher must immediately report the removal to the principal or designee
  2. Teacher-parent conference — The teacher must request a parent/guardian conference as soon as possible
  3. Supervised placement — The student must be placed under appropriate supervision during the removal (not just sent home)
  4. No repeated class removal without referral — A student removed more than once should be referred for additional support

Dean/Counselor Responsibilities Upon Referral

When a student is referred to the office after classroom removal:

  1. Conduct a brief cooling-off period (5–10 minutes)
  2. Interview the student — Get their perspective on what happened
  3. Contact parent/guardian — Inform them of the removal
  4. Determine next steps — Conference, behavior contract, counseling referral, or other intervention
  5. Document the incident — Record in the student information system
  6. Follow up with the teacher — Discuss the teacher-parent conference and any interventions

Important Notes

  • The teacher cannot require the student to remain out of class beyond the removal period
  • The principal may allow the student to return to class early if appropriate
  • Classroom removal is not the same as a formal administrative suspension
  • Teachers should use removal as a last resort after trying classroom management strategies
