Mandatory vs. Discretionary Expulsion (EC §48915)
Mandatory Recommendation for Expulsion
The principal must recommend expulsion if a student commits any of the following at school or a school activity:
- Possessing, selling, or furnishing a firearm
- Brandishing a knife at another person
- Selling a controlled substance
- Committing or attempting sexual assault or battery (as defined in Penal Code)
- Possession of an explosive device
Discretionary Recommendation
The principal may recommend expulsion for other violations under EC §48900 if they determine:
- Other means of correction are not feasible or have been unsuccessful
- The student's presence causes a continuing danger
AB 1230 — New Requirements (Effective January 1, 2026)
Rehabilitation Plan Requirements
AB 1230 strengthens EC §48916 by requiring rehabilitation plans to:
- Meet the individual needs of the student
- Address the specific behavior that led to expulsion
- Review educational options during the expulsion period
- Include a transition plan for returning to the school of origin
- Be developed with input from the student and parent/guardian
- Include periodic reviews and preliminary assessments
Readmission Procedures
AB 1230 amends EC §48916.1 to require:
- A district to adopt rules establishing readmission procedures
- The student to demonstrate compliance with the rehabilitation plan
- A readmission hearing within a specified timeframe
- Consideration of the student's progress and behavior during expulsion
- A written decision with reasons if readmission is denied
Rehabilitation Plan During Expulsion
The expelled student must be:
- Referred to a community school, alternative education program, or county community school
- Provided with educational services during the expulsion period
- Offered counseling and support services as part of the rehabilitation plan
Dean/Counselor Role in Expulsion
- Document thoroughly — All incidents, prior interventions, and communications with family
- Participate in the hearing — Provide evidence and testimony if needed
- Develop rehabilitation plan — Work with the student and family on a meaningful plan
- Monitor progress — Track the student's compliance with rehabilitation requirements
- Facilitate readmission — Support the transition back to the school of origin
